1. Service Description

ShopGrowth is an AI-powered Meta ads analysis tool designed for Shopify brands. The Service connects to your Meta Ads account, analyzes campaign performance, detects ad fatigue, and generates actionable recommendations to help you scale your advertising results. By accessing or using ShopGrowth, you agree to be bound by these Terms.

2. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating your account.
• Keep your login credentials secure and not share them with third parties.
• Notify us immediately of any unauthorized use of your account.
• Ensure you have the rights and permissions to connect the Meta ad accounts you link to ShopGrowth.
• Comply with Meta's Platform Terms and all applicable laws when using this Service.

3. Acceptable Use

You agree not to misuse ShopGrowth. Prohibited activities include, but are not limited to:

• Using the Service for any unlawful purpose or in violation of any regulations.
• Attempting to gain unauthorized access to any part of the Service or its infrastructure.
• Reverse engineering, decompiling, or disassembling any portion of the Service.
• Reselling, sublicensing, or otherwise commercializing access to the Service without our written consent.
• Uploading or transmitting viruses or any other malicious code.

4. No Warranty / Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL SHOPGROWTH, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

5. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Puerto Rico.

6. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
